Casa Dragones Tequila Company in association with
Playa Holding Corporation (Casa Dragones Tequila Company and Playa Holding Corporation are
referred to hereinafter collectively as “we”). The purpose of this
Privacy Policy is to inform you of the following: (1) what information
we may collect from or about you via our Site, and how we collect and
use such information; (2) how we may share such information with third
parties; and (3) your rights and choices regarding such information.
This Policy is an integral part of the
Terms and Conditions of Website Use for our Site.
PLEASE READ THIS POLICY CAREFULLY BEFORE USING OUR SITE. By using our
Site, you acknowledge that you have read this Privacy Policy in its
entirety, and agree to be bound by its terms.
NOTICE TO CALIFORNIA RESIDENTS – YOUR CALIFORNIA PRIVACY RIGHTS
Effective January 1, 2005, under California Civil Code Section
1798.83 (known as the “Shine the Light” law), if a business has within
the immediately preceding calendar year disclosed a California
customer’s personal information to a third party and knows or should
have known that such third party used the information for its own
direct marketing purposes, then that business is obligated to disclose
in writing to the California customer upon request, what personal
information was shared and with whom it was shared. A business may
comply with this law by: (1) having EITHER a published privacy policy
of not sharing a customer’s personal information for third parties’
direct marketing use unless the customer has first affirmatively opted
in to such sharing OR a published privacy policy of not sharing a
customer’s personal information for third parties’ direct marketing use
if the customer has opted out to prevent his/her personal information
from being shared for direct marketing use; AND (2) notifying the
customer of his/her right to opt out and providing a cost-free means
for the customer to exercise that right.

Please note that under this law, we are not required to respond to a
customer‘s request more than once in a calendar year, nor are we
required to respond to any request that is not sent to the mailing
address or email address designated above.
PROTECTING CHILDREN
Our Site does not target children nor provides products or
services for use by children. We do not knowingly collect personal
information from persons under the legal drinking age (e.g., the legal
drinking age in the U.S. is 21). If you are under the legal drinking
age for your locality, you may not use our Site.
CHANGES AND UPDATES
We reserve the right to change and update this Privacy Policy at any
time in our sole discretion. For example, we may amend this Privacy
Policy to incorporate additional rules and policies as may be
established for our Site from time to time, and/or to comply with or
adopt any changes in law or industry practices. If we make changes and
updates to this Privacy Policy, we will notify users of such changes
and updates by posting a public announcement on our Site. If you have
provided an email address to us, we may also notify you of such changes
and updates via email. In addition, if you have an established account
with our Site, we may ask you to affirmatively consent to and accept
such changes and updates at the time of your next account login on our
Site. By continuing to use our Site after such notice and/or consent,
you agree to be bound by our Privacy Policy as modified.
COLLECTION AND USE OF INFORMATION ABOUT YOU

Personal Information. This refers to a user’s
personally identifiable information, such as first and last name,
telephone number, email address, mailing address, date of birth, and
credit card information. You can visit many areas on our Site without
having to disclose any personal information (except that we may require
you to state your date of birth for age-screening purposes prior to
entering our Site). However, we do collect and use personal information
in the following circumstances:

Electronic Mailing List: We use an electronic
mailing list to distribute our electronic newsletters, announcements,
notices, marketing and promotional materials, and other communications
to users of our Site. To join such mailing list, you will need to
provide us with your email address, which we will collect and use for
electronic mailing purposes (subject to your right to opt out as
described below). Also, from time to time we may include a forwarding
button in our electronic mailings to allow you to share the information
with friends and/or family members who wish to receive the information
(provided that we may limit the number of recipients to whom you can
forward and provided further that you may not use forwarding for
spamming, harassment, or other unlawful or unauthorized purposes). If a
proposed recipient accepts receipt of the information forwarded at your
request, we may add that recipient’s email address to our electronic
mailing list (subject to his/her right to opt out as described below).

Email Contacts: If you make an inquiry or
request to us via email, we will collect and use your email address to
communicate with you regarding your inquiry or request, and will
include your email address on our electronic mailing list (subject to
your right to opt out as described below).
(c)
Facebook Fan Page, etc.: We may establish fan
page on Facebook and/or other third-party social-networking sites. To
join our fan page, you will need to provide certain personal
information (such as your name and email address) to us. We collect and
use such information to communicate and stay in contact with our fans.
Also, upon you joining our fan page, your email address will be
included on our electronic mailing list (subject to your right to opt
out as described below).
(d)
Online Surveys: From time to time we may conduct
online surveys to gather opinions, comments, suggestions, etc. about
our Site from our users. Typically, our online surveys may be completed
and submitted by users anonymously without disclosing any personal
information. However, some of our online surveys may ask you to
disclose certain personal information (such as your name and email
address) to us, and if you choose to participate in such a survey, we
will collect such personal information from you and will include your
email address on our electronic mailing list (subject to your right to
opt out as described below).
(e)
Online Promotions: From time to time we may
offer contests, sweepstakes and/or other prize promotions (each a
“Promotion”) on our Site. To enter such a Promotion, you will need to
provide certain personal information (such as your name, email address,
mailing address, etc.) to us. Personal information so collected will be
used to conduct and administer the Promotion, including fulfilling
prizes to the winners. Also, upon you entering such a Promotion, your
email address will be included on our electronic mailing list (subject
to your right to opt out as described below).

Online Transactions: If you engage in an online
transaction with us (e.g., an online purchase), we will need to collect
certain personal information (such as your name, email address, mailing
address, and credit card information) from you in order to process,
manage and fulfill your transaction, including, without limitation,
processing credit card payments for goods that you order from us or any
of our agents or vendors, and fulfilling delivery of your order. Also,
as a customer, your email address will be included on our electronic
mailing list (subject to your right to opt out as described below).

Log File Data and Cookie Session Information. When users visit our Site, our web servers will automatically generate
log files that contain data that can be linked to individual users,
such as IP addresses, ISP domain names, browser types, operating
systems, referring/exit pages, date/time stamps, clickstream data, etc.
Also, to the extent a visitor has enabled “cookies” in his/her browser,
we may use “cookies” to collect session information about users’ visits
to our Site, including tracking their path through our Site and where
they came from (for example, if they arrive via a search engine). We
use log file data and cookie session information INTERNALLY for the
operation of our Site as well as to generate and analyze aggregate data
about our users as a group. When we report information about our Site
to our partners, sponsors and investors, we report only aggregate data
(see the paragraph below).

Aggregate Data. This is any information
collected or compiled in aggregate form, without identifying any user
individually. For example, we may collect aggregate tracking
information derived mainly from tallying page views throughout our
Site. Also, we may gather or compile demographic and/or other aggregate
data about our users as a group. We use aggregate data to administer
and monitor our Site, to analyze Site traffic and usage patterns and
trends, to improve the functionality of our Site, and to enable us to
personalize and better users’ experience on our Site. We may report
aggregate data about our Site to our partners, sponsors and investors,
and may also share such data with outside vendors for market analysis,
marketing and/or promotional purposes.
SHARING OF INFORMATION ABOUT YOU WITH THIRD PARTIES
As a general matter, we do not share your personal information
with third parties, except in the following limited circumstances.
(a) We may employ outside contractors, vendors and service
providers to perform services for us or for our Site, and may share
your personal information with such contractors, vendors and service
providers to the extent necessary for them to perform such services.
For example, our IT service providers may be given access to your
personal information as necessary to perform support or maintenance for
the operation of our Site, such as data backup and storage. As another
example, an authorized vendor may be given access to your personal
information in order to process and fulfill an online purchase you have
made with us. We require that our contractors, vendors and service
providers limit their use of your personal information solely to the
purposes for which it was disclosed by us, and that they maintain the
confidentiality, security and integrity of such information and not
make any further disclosure to others.

parties if doing so is required by law or in response to a court or
government order or subpoena or, in our good faith belief, is
reasonably necessary to: (i) comply with legal process; (ii) enforce

Terms and Conditions of Website Use;
(iii) respond to third-party infringement claims relating to any
information or material you furnish to us; (iv) respond to an
emergency; or (v) protect the rights, property or safety of our
company, our Site, and/or the public.
(c) If our company is acquired by or merged with or into
another entity, or if all or substantially all of our assets are
transferred to another entity, your personal information may be
transferred to such entity as part of the transaction, and that entity
and its affiliates may use your personal information under the terms of
their own privacy policies which may differ from this Privacy Policy.
We do not knowingly share your personal information with a third party
for such third party’s direct marketing use (i.e., to enable such third
party to contact you directly to market and promote its goods or
services), unless we have your affirmative consent to such sharing.
USER CHOICES AND OPT-OUT

Electronic Mailings. You may opt out of receiving electronic mailings from our Site at any time by contacting us at
info@CasaDragones.com or by using the “opt out” or “unsubscribe” option provided in the
electronic mailings you already received from us. We generally process
an opt-out request within 10 business days after our receipt thereof.
Upon processing of your opt-out request, we will not reuse your email
address (subject to the limited exceptions specified below) unless you
rejoin our electronic mailing list or otherwise affirmatively opt in to
receive electronic mailings from us. However, you acknowledge and agree
that the preceding sentence is subject to the following limited
exceptions: (a) even after you opt out, we may notify you via email (as
required or permitted by law) concerning any security breach or
suspected security breach that may affect your personal information
stored by or for us; and (b) to the extent you have an established
account with our Site (whether in the nature of a membership account, a
transaction account, or otherwise), even after you opt out, we may
notify you via email concerning any material changes to this Privacy
Policy or the
Terms and Conditions of Website Use for our Site.

Update and Correction. If you have an established
account with us (whether in the nature of a membership account, a
transaction account, or otherwise), you may log into such account at
any time to modify, update, correct and delete your personal
information under the account. However, you understand and acknowledge
that deletion of certain personal information (e.g., your name and
email address) may result in cancellation of your account.
COOKIES
Our Site uses cookies, which is a small encrypted data string
stored on your computer or device. Cookies help us deliver content
specific to your interests and permit our servers to recall information
from your previous visits to our Site. We may use internally for the
operation of our Site information collected from cookies together with
personal information disclosed by you. We do not, however, use cookies
to access information on your computer or device. Most Internet

own, control or operate such linked sites, and is not responsible for

SECURITY
We understand the importance of protecting the security and
integrity of personal information that our users have shared with us.
Unfortunately, no data transmission over the Internet and no data
storage can be 100% secure. Consequently, while we will endeavor to
safeguard your personal information against unauthorized access and
disclosure, we do not warrant or guarantee the security of any
information you transmit to, from or on our Site. We will notify you in
the event we become aware of a breach or suspected breach of the
security of your personal information stored by or for us.
All credit card information provided by you in connection with an
online transaction with our Site will be protected by encryption using
the standard Secure Sockets Layer (SSL) protocol, and we do not retain
your credit card information after the processing of the transaction is
complete.
Information that you post in any public, community or
interactive areas on our Site (e.g., chat rooms, bulletin boards,
message boards, and discussion groups) will be accessible to, and may
be collected and used by, others and may result in unsolicited or
