Welcome to the website www.CasaDragones.com (“our Site”) which is operated by Casa Dragones Tequila Company in association with Playa Holding Corporation (Casa Dragones Tequila Company and Playa Holding Corporation are referred to hereinafter collectively as “we”). The purpose of this Privacy Policy is to inform you of the following: (1) what information we may collect from or about you via our Site, and how we collect and use such information; (2) how we may share such information with third parties; and (3) your rights and choices regarding such information. This Policy is an integral part of the Terms and Conditions of Website Use for our Site.

PLEASE READ THIS POLICY CAREFULLY BEFORE USING OUR SITE. By using our Site, you acknowledge that you have read this Privacy Policy in its entirety and agree to be bound by its terms.

1. CHANGES TO THIS PRIVACY POLICY

The Effective Date of this Privacy Policy is set forth at the top of this webpage. We will notify you in advance if we make any material change by posting notice on this webpage and, when possible, contacting you using the email address you have provided to us (if any). We will not make retroactive changes that reduce your privacy rights unless we are legally required to do so. Your continued use of our Site after the Effective Date constitutes your acceptance of the amended Privacy Policy. The amended Privacy Policy supersedes all previous versions.

2. NOTICE TO CALIFORNIA RESIDENTS – YOUR CALIFORNIA PRIVACY RIGHTS

Under California Civil Code Section 1798.83 (known as the “Shine the Light” law), if a business has within the immediately preceding calendar year disclosed a California customer’s Personal Information to a third party and knows or should have known that such third party used the information for its own direct marketing purposes, then that business is obligated to disclose in writing to the California customer upon request, what personal information was shared and with whom it was shared. A business may comply with this law by: (1) having EITHER a published privacy policy of not sharing a customer’s personal information for third parties’ direct marketing use unless the customer has first affirmatively opted in to such sharing OR a published privacy policy of not sharing a customer’s personal information for third parties’ direct marketing use if the customer has opted out to prevent his/her personal information from being shared for direct marketing use; AND (2) notifying the customer of his/her right to opt out and providing a cost-free means for the customer to exercise that right.

Please note that under the Shine the Light law, we are not required to respond to a customer‘s request more than once in a calendar year, nor are we required to respond to any request that is not sent to the mailing address or email address designated above.

3. PROTECTING CHILDREN

Our Site does not target children nor provides products or services for use by children. We do not knowingly collect Personal Information from persons under the legal drinking age (e.g., the legal drinking age in the U.S. is 21). If you are under the legal drinking age for your locality, you may not use our Site.

5. WHAT INFORMATION DO WE COLLECT?

We collect two types of information (“Information”):

  • “Personal Information” is information associated with or that can be used to identify a specific individual, such as name, email address, postal address, zip code or telephone number. Our definition of Personal Information does not include information that has been aggregated or modified so that it can no longer be used, whether alone or in combination with other information, to identify a specific person.
  • “General Information” is information about an individual’s online activity that, alone, cannot be used to identify him or her, such as browser type, operating system, domain name and the dates/times of Site access.

Personal Information and General Information may be linked together. Different types of General Information also may be linked together and, once linked, used to identify a unique individual.

5. HOW WE COLLECT INFORMATION

You can visit many areas on our Site without having to disclose any Personal Information (except that we may require you to state your date of birth for age-screening purposes prior to entering our Site). However, we do collect and use Personal Information in the following circumstances:

  • Electronic Mailing List:We use an electronic mailing list to distribute our electronic newsletters, announcements, notices, marketing and promotional materials, and other communications to users of our Site.   • Email Contacts:If you make an inquiry or request to us via email, we will collect and use your email address and any other information you provide to communicate with you regarding your inquiry or request, and will include your email address on our electronic mailing list.
  • Facebook Fan Page, etc.:We may establish a fan page on Facebook and/or other third-party social media sites. To join our Facebook page, you will need to provide certain Personal Information (such as your name and email address) to us. We collect and use such information to communicate and stay in contact with our fans. Also, upon you joining our Facebook page, your email address will be included on our electronic mailing list.
  • Online Surveys:From time to time we may conduct online surveys to gather opinions, comments, suggestions, etc. about our Site from our users. Typically, our online surveys may be completed and submitted by users anonymously without disclosing any Personal Information. However, some of our online surveys may ask you to disclose certain Personal Information (such as your name and email address) to us, and if you choose to participate in such a survey, we will collect such Personal Information from you and will include your email address on our electronic mailing list.
  • Online Promotions:From time to time we may offer contests, sweepstakes and/or other prize promotions (each a “Promotion”) on our Site. To enter a Promotion, you will need to provide certain Personal Information (such as your name, email address, mailing address, etc.) to us. Personal Information collected will be used to conduct and administer the Promotion, including fulfilling prizes to the winners. Also, upon you entering such a Promotion, your email address will be included on our electronic mailing list.
  • Online Transactions:If you engage in an online transaction with us (e.g., an online purchase), we will need to collect certain Personal Information (such as your name, email address, mailing address, and credit card information) from you in order to process, manage and fulfill your transaction, including, without limitation, processing credit card payments for goods that you order from us or any of our agents or vendors, and fulfilling delivery of your order. Also, as a customer, your email address will be included on our electronic mailing list.

6. HOW WE USE TRACKING TOOLS, RESPOND TO DO NOT TRACK AND USE TARGETED ADVERTISING

We may collect Information automatically through the use of cookies, web beacons and other data collection tools (collectively, “Tracking Tools”). Tracking Tools refers to any technology that collects Information about your use of the Services and also may collect Information about your activities when you leave our Site and visit other websites on the Internet.

We generally process an opt-out request within 10 business days after our receipt thereof. Upon processing of your opt-out request, we will not reuse your email address (subject to the limited exceptions specified below) unless you rejoin our electronic mailing list or otherwise affirmatively opt in to receive electronic mailings from us. However, you acknowledge and agree that the preceding sentence is subject to the following limited exceptions: (i) even after you opt out, we may notify you via email (as required or permitted by law) concerning any security breach or suspected security breach that may affect your personal information stored by or for us; and (ii) to the extent you have an established account with our Site (whether in the nature of a membership account, a transaction account, or otherwise), even after you opt out, we may notify you via email concerning any material changes to this Privacy Policy or the Terms and Conditions of Website Use for our Site.
  • Update and Correction.If you have an established account with us (whether in the nature of a membership account, a transaction account, or otherwise), you may log into such account at any time to modify, update, correct and delete your Personal Information under the account. Our Site may contain links to third-party websites. We do not own, control or operate Linked Sites, and is not responsible for the privacy policies or practices of Linked Sites. Privacy policies and practices for Linked Sites may differ from our Privacy Policy and practices. You access and use Linked Sites entirely and solely at your own risk. 10. SECURITY

We understand the importance of protecting the security and integrity of Personal Information that our users have shared with us. Unfortunately, no data transmission over the Internet and no data storage can be 100% secure. Consequently, while we will endeavor to safeguard your Personal Information against unauthorized access and disclosure, we do not warrant or guarantee the security of any information you transmit to, from or on our Site.
